Preamble

This Acceptable Use Policy (“Policy”) governs the permitted and prohibited uses of the Maritime Bidding Network platform (the “Platform”).

The Platform is operated by Maritime Bidding Network LLC, 222 Salamanca Ave, Coral Gables, Florida 33134, United States. Entity ID: L25000134815.

This Policy forms part of the Maritime Bidding Network Terms of Service. All users of the Platform (“Users”) agree to comply with this Policy when accessing or using the Platform.

Failure to comply with this Policy may result in suspension or termination of access to the Platform.

1. PURPOSE OF THIS POLICY

The Maritime Bidding Network platform is designed to facilitate structured maritime procurement, tendering, contract coordination, and documentation workflows.

This Policy exists to protect the integrity of procurement processes, the safety and reliability of the Platform, the trust of contracting parties, and the accuracy of platform records and documentation.

Users must use the Platform only for lawful and legitimate professional purposes consistent with maritime procurement and contract management.

2. PERMITTED USE

Users may use the Platform to conduct legitimate maritime procurement and contracting activities.

All platform activity must reflect genuine commercial operations within the maritime industry.

Users must ensure that all information submitted through the Platform is accurate and submitted in good faith.

  • exchange contract documentation
  • coordinate project execution
  • communicate within workrooms
  • upload technical and contractual materials
  • document project milestones
  • maintain operational records related to procurement and contracts

3. PROHIBITED CONDUCT

Users must not engage in conduct that compromises the integrity, security, or lawful operation of the Platform.

Prohibited activities include, but are not limited to, the following.

3.1 Fraudulent Procurement Activity

Users must not engage in fraudulent procurement activity or deceptive conduct within the Platform.

  • publish fraudulent tenders
  • submit bids with no intent to perform the work
  • manipulate procurement outcomes through deceptive conduct
  • submit false credentials or certifications
  • impersonate other companies or entities

3.2 Bid Manipulation and Collusion

Users must not manipulate or distort procurement competition.

  • coordinate bids with competitors for the purpose of manipulating tender outcomes
  • artificially inflate or suppress bid pricing
  • engage in undisclosed agreements intended to distort procurement processes

3.3 Misrepresentation of Authority

Users must not misrepresent their authority to act on behalf of vessels or organizations.

  • submit tenders or bids without authorization
  • falsely claim ownership or management authority

3.4 Uploading Unlawful or Infringing Materials

Users must not upload or distribute unlawful, fraudulent, or infringing materials.

  • documents that violate intellectual property rights
  • fraudulent documentation
  • malicious software
  • materials that violate applicable laws
  • forged contracts
  • unauthorized engineering drawings
  • malware or harmful code

3.5 Platform Interference

Users must not interfere with the normal operation of the Platform.

  • attempting unauthorized system access
  • disrupting system infrastructure
  • introducing malicious code
  • exploiting platform vulnerabilities
  • bypassing platform security mechanisms

3.6 Automated Data Extraction

Unauthorized automated access to the Platform is prohibited.

  • scraping platform data
  • harvesting user information
  • automated monitoring of tenders or bids using bots or scripts

3.7 Harassment or Abuse

The Platform must be used for professional and respectful collaboration.

  • harassing other users
  • sending abusive communications
  • intimidating contracting parties
  • disrupting professional procurement collaboration

3.8 Misuse of Dispute Documentation Tools

Dispute documentation tools must be used in good faith.

  • submitting knowingly false dispute claims
  • fabricating evidence or records
  • manipulating documentation for fraudulent purposes

4. PLATFORM SECURITY

Users must respect platform security mechanisms designed to protect system integrity and operational reliability.

  • probing or testing system vulnerabilities without authorization
  • attempting to bypass authentication systems
  • accessing accounts belonging to other users

5. INVESTIGATION AND ENFORCEMENT

MBN reserves the right to investigate suspected violations of this Policy.

Where violations are identified, MBN may take enforcement actions including warnings, account suspension, account termination, removal of materials, or reporting unlawful conduct to appropriate authorities.

MBN may preserve platform records to support investigations or legal proceedings.

6. COOPERATION WITH LEGAL AUTHORITIES

MBN may cooperate with law enforcement or regulatory authorities where required by applicable law.

Platform records may be preserved or disclosed to comply with legal obligations, respond to lawful governmental requests, or support investigations into unlawful conduct.

7. POLICY UPDATES

MBN may update this Acceptable Use Policy from time to time to reflect changes in platform functionality, operational practices, or legal requirements.

Updated versions will be published on the Platform with an updated effective date.

Continued use of the Platform following updates constitutes acceptance of the revised Policy.

In the event of any discrepancy, conflict, or difference in interpretation between translated versions of this Acceptable Use Policy, the English version shall prevail and be legally binding.
